BUTZ F.T.C. ROLE TARGET ININQUIRY; Cox Office Looks Into Wine Company Acquisition

Informed Washington sources say on Oct 26 that Agr Sec E L Butz is under investigation in connection with alleged attempt to influence FTC investigation in '72 for pol purposes; incident revolves around '69 acquisition by Heublein Inc of Calif wine cooperative United Vitners Inc; sources say that matter was reptd in Aug '73 to office of former special Watergate prosecutor A Cox and it was referred to study panel investigating campaign financing; claim that investigation is still continuing despite dismissal of Cox; during spring of '72, FTC's Competition Bur, in recommendation to 5 comrs, suggested that acquisition constituted illegal restraint of trade and should be formally challenged; Butz requested meeting with former comm Chmn M Kirkpatrick before comrs could act on recommendation; Butz argued against proposed challenge by suggesting that it might be detrimental to wine growers involved; failing to persuade Kirkpatrick, Butz reptdly asked Kirkpatrick to delay challenge until after Presidential election, implying that challenge would hurt Pres Nixon's re-election efforts; former Competition Bur official holds that Butz's approach to Kirkpatrick came after Agr Dept tried for several mos to dissuade bur from challenge, although it is not clear whether Butz's proposal and earlier efforts were connected; Kirkpatrick, 'furious' at suggestion of delay, presented proposed challenge to his fellow comrs and voted for it himself; Kirkpatrick's legal adviser M Corash decided to discuss matter with Cox's office; Kirkpatrick confirms basic details of meeting, including Butz's attempt to place matter in pol context; refrains, however, to discuss details of matter or to characterize Butz's proposal

ITU Local 6 pres B A Powers on Oct 26 discloses that union has proposed formula that he says 'will postpone and, hopefully, completely avert confrontation,' with NY Times, Daily News and NV Post in their current contract negotations; warns that if meeting on Oct 30 does not produce satisfactory agreement 'alternative action will definitely be taken regardless of any request by the publishers or any other party for further postponement'; NY Times has obtained injunction enjoining union from striking or taking other action that would interfere with newspaper production; NY Newspaper Guild vp J E Deegan says that Guild has recd authorization from its parent union to call strike at Times or News if necessary, to achieve 'just' contract settlement; Guild announces that on Oct 26 it filed charge of discrimination against Times with EEOC on behalf of Times employes in Guild jurisdiction charging that employment practices of Times discriminate against nonwhites
